Our tax system and the officials working within it are subject to the rules of natural justice and procedural fairness. They only have as much power as Parliament and the Legislation gives them. There are at least two avenues available to taxpayers to ensure that the Canada Revenue Agency (CRA) acts within its boundaries and any unreasonable behaviour by an Agent of the CRA is properly addressed. The first of these is an informal service complaints system overseen by the Tax Ombudsman and the second is an Application to the Federal Court to formally review a decision of a CRA Agent.
I feel it is extremely important that all taxpayers’ complaints are dealt with properly as it should not be forgotten that the CRA is our Agency. We, Canadians, pay the wages of the people the Agency employs through our tax dollars and every Canadian taxpayer should be treated fairly and with courtesy and respect. Many taxpayers are afraid to complain against CRA Agents because they think it may lead to an audit or other repercussions but the Taxpayer Bill of Rights gives all taxpayers the right to be treated professionally and to file a complaint when necessary. Complaints must be made to ensure that those Agents who are not following the rules and boundaries of their job are replaced with those who will.
Applications for Judicial Review can be considered when an Agent has not followed the principles of justice and procedural fairness in making a decision about your situation. These applications are common in challenging a discretionary decision made by the CRA, such as whether to grant taxpayer relief or accept voluntary disclosures. In such an application, the Court acts as an impartial adjudicator to ensure that the CRA are acting reasonably and will overturn and remedy any abuse of power or unjust decision made by a CRA Agent.
